
Norfolk County and Warren Cummings appeared in a virtual courtroom today as Cummings continues to challenge the conduct of council. Representing himself and other residents, Cummings has requested the Ontario Superior Court of Justice to review the actions of the council.
Since filing his concerns, Cummings has withdrawn most of his points after the Integrity Commissioner addressed them. Remaining issues include a review of the election committee and the council’s conduct regarding community notice on Waterford’s growth and development.
The County’s lawyer has asked the court to dismiss the case under Rule 2.1.02, calling it “frivolous and an abuse of process.” The lawyer argued that Cummings lacks the legal standing to bring these concerns to court.
The judge has directed Cummings to submit written reports on his remaining concerns. A decision will be made outside of court as to whether they are an abuse of process, and Norfolk County plans to seek legal costs from Cummings regardless of the outcome.
